"If UltraViolet can drive consumers to adopt a cloud-based film ownership model in any material way, stocks that have material studio assets would likely see higher earnings and multiple expansion." In a bull case scenario that he outlined, UltraViolet could drive about 10 percent upside to film studios' earnings before interest, taxes, depreciation and amortization. In that scenario, films bought rather than rented per household could rise to more than seven per year by 2015 from an estimated 6.8 this year. "If UltraViolet is able to drive film buying habits back to 2004 levels - at over 12 films purchased per household annually - the upside would be even greater," Swinburne said. But the analyst also highlighted key challenges. "Disney and Apple remain on the sidelines, inhibiting universal adoption," Swinburne said. "Disney currently plans to launch its own version of a "digital locker" called Disney Studio All Access that uses a different file format than UltraViolet's Common File Format, making it difficult for users to keep their UltraViolet films and Disney films in the same place." For now, it is early days, with the start of 2012 potentially bringing another incentive for consumers. "We expect legal-copy upload capability (allowing consumers to upload current DVD inventory into the cloud) to begin rolling out by the first quarter 2012, potentially spurring new purchase activity," Swinburne said. Miller Tabak analyst David Joyce also said it was too early to predict the impact of UltraViolet. "The big question is how does the consumer like whatever price points emerge and how cannibalistic might it become for future platform releases and growth," he told The Hollywood Reporter. "I am hopeful that the risk and opportunity will be balanced" though, he added. The key question will be whether a studio will be able to charge a higher price of, say, $30 now for a consumer to have access to a piece of content in perpetuity instead of getting less money plus another $20 five years from now for a new device. While lauding studios for looking at digital options, BTIG analyst Richard Greenfield was particularly bearish about UltraViolet, highlighting that it doesn't work with iTunes and doesn't easily work with Apple devices. "While we are skeptical that anything can reinvigorate the purchase of home entertainment beyond drastically reducing prices points (relative to rental), forcing consumers to use your infrastructure versus theinfrastructurethey are comfortable with requires a "complete" solution, which the UltraViolet-ecosystem simply is not today," he said in a blog post. Golden Globes Trial Won't Begin Before March 2012

Matz, the new federal judge in Los Angeles, who will oversee the case, and ultimately decide which side prevails (since both sides have agreed there will be no jury). However, the HFPA filed a motion Thursday asking that the court date be set sooner than that because "postponing trial until next summer will prolong the present uncertainty regarding the broadcast right," explains the filing, "and undermine substantial efforts... to streamline the issues in this case to secure a prompt adjudication of the parties' rights." STORY: Golden Globes Trial: Inside One of TV's Messiest, Nastiest Battles The new judge in the case has scheduled a pre-trial status conference for the end of November. However, the HFPA in their filing asked for a telephone conference call before that -- as soon as next week -- to speed up the process, and hopefully arrange for a trial to commence sooner than what is being discussed. The HFPA filing notes that all of the pre-trial work in the case was completed, including various motions and witness lists, before the last minute cancellation; so both sides are essentially ready to go. According to the filing there is another issue. Attorney Daniel Petrocelli, who is co-counsel for the HFPA with Linda J. Smith, will not be available for trial between February and July 2012, due to other obligations. After the trial was postponed in September because the judge then expected to try the case became ill, both sides agreed to a deal with NBC to carry the Globes telecast January 15, 2012, so as not to disrupt the show. However, the HFPA filing says despite this "one-time, non-precedential agreement... an expeditious resolution...remains of paramount importance." STORY: Golden Globes Trial Witness List Includes Les Moonves, Marc Graboff and Dick Clark Another source said that the pressure to have a trial as soon as January is largely driven by Petrocelli's not being available for such a long period next spring and summer. Based on his unavailability, the judge could not schedule the trial before next August or some time after that. Such a postponement could mean the rights for the 2013 Globes telecast could again become an issue, which might lead to another one-year contract extension with NBC. That would be fine with Dick Clark, said the source, but would not be what the HFPA wants to happen. There have been unconfirmed reports that there were mediation attempts in the past few months to try and reach an out of court settlement, but they were not successful.
